1. Who we are

ShiftPrep ("ShiftPrep", "we", "us", "our") is operated by HealthCareShiftPrep. By using our website, applications, or services (together, the "Service"), you ("you", "user") agree to these Terms & Conditions (the "Terms"). If you do not agree, do not use the Service.

2. The Service

ShiftPrep provides AI-powered interview preparation for nurses, certified nursing assistants, medical assistants, and other allied health professionals. Features include mock behavioral interview practice, role and specialty-specific question banks, STAR-method feedback, and a saved answer library.

3. Eligibility & account

You must be of legal age in your jurisdiction to enter a contract. You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

4. Acceptable use

You must not use the Service to:

  • Violate any law, regulation, or third-party right;
  • Engage in fraud, spam, or deceptive conduct;
  • Infringe intellectual property or privacy rights;
  • Interfere with the security or integrity of the Service, including by introducing malware, probing for vulnerabilities, or scraping at scale;
  • Resell, redistribute, or circumvent technical limits of the Service;
  • Reverse engineer, decompile, or attempt to extract source code.

5. AI features and your responsibility

The Service uses generative AI to produce practice questions, feedback, and related content ("AI Outputs"). You are responsible for the prompts and content you submit ("AI Inputs") and for how you use AI Outputs.

  • You must not submit content you do not have the right to submit, or use the Service to generate illegal content, harassment, hate speech, malware, deepfakes, or content designed to deceive employers or licensing bodies.
  • You must not attempt to jailbreak, bypass safety filters, or extract underlying model data.
  • You are responsible for verifying AI Outputs before relying on them. We may remove content, refuse outputs, or suspend accounts that violate these Terms.

Accuracy disclaimer. AI Outputs may be inaccurate, incomplete, or out of date. ShiftPrep is interview practice software. It is not medical advice, clinical guidance, legal advice, or career counseling, and is not a substitute for professional judgment, your employer's policies, or licensing-board requirements. Do not rely on AI Outputs for patient care decisions.

6. Intellectual property

We own the Service and all associated intellectual property, including software, question banks, prompts, branding, and documentation. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with your plan and these Terms. You retain ownership of your AI Inputs and your saved answers, and you grant us a limited license to host, process, and display them solely to provide the Service to you.

7. Payments, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. See our Refund Policy for our money-back guarantee.

8. Service availability

We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends; we may delete your data after a reasonable export window.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service is limited to the fees you paid to us in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as fraud, death, or personal injury caused by negligence).

11. Indemnity

You will indemnify and hold us harmless from any claim arising from your AI Inputs, your use of AI Outputs, your unlawful use of the Service, or your breach of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of England, United Kingdom, without regard to conflict-of-law rules. The courts of England, United Kingdom have exclusive jurisdiction, except where mandatory consumer law gives you the right to bring proceedings in your home country.

13. Changes

We may update these Terms from time to time. Material changes will be notified via the Service or email. Continued use after the effective date constitutes acceptance.
